Welcome to Hashboard, the analytics tool that brings teams closer to their data by Glean Data Inc., d/b/a Hashboard ("Hashboard"," "we," or "us"). Your use of this web application (the "Application") and the services made available on the Application is subject to these Terms of Use (these "Terms"). By using any of our Services, you agree to be bound by, and use our Services in compliance with, these Terms of Use.

If you do not agree to these terms of use, do not use our services.

We may make changes to these Terms from time to time. When we do, we will revise the "last updated" date given above. It is your responsibility to review these Terms frequently and to remain informed of any changes to them. The then current version of these Terms will supersede all earlier versions. You agree that your continued use of our Services after such changes have been published to our Services will constitute your acceptance of such revised Terms.

License to use our services

Subject to these Terms, we grant to you a limited, non-exclusive, non-transferable license to use our Services for your professional use and not for resale or further distribution. Your right to use our Services is limited by all terms and conditions set forth in these Terms. Except for your pre-existing rights and this license granted to you, we retain all right, title and interest in and to our Services, including all related intellectual property rights. Our Services are protected by applicable intellectual property laws, including United States copyright law and international treaties. Except as otherwise explicitly provided in these Terms or as may be expressly permitted by applicable law, you will not, and will not permit or authorize any third party to: (i) reproduce, modify, translate, enhance, decompile, disassemble, reverse engineer or create derivative works of any of our Services (ii) rent, lease or sublicense access to any of our Services or (iii) circumvent or disable any security or technological features or measures of our Services.

Access to our services

We do not provide you with the equipment to access our Services. You are responsible for all fees charged by third parties related to your access and use of our Services (e.g. charges by Internet service providers). We will not be liable to you or to any third party for any modification, suspension or discontinuance of all or any portion of our Services.

Restrictions

You must comply with all applicable laws when using our Services. Except as may be expressly permitted by applicable law, or as Hashboard may authorize expressly in writing, you will not, and will not permit anyone else to: (i) store, copy, modify, distribute, or resell any of the information audio, visual, and audiovisual works, or other content made available on our Services (collectively, "Service Content") or compile or collect any Service Content as part of a database or other work (ii) use any automated tool (e.g., robots, spiders) to access or use our Services or to store, copy, modify, distribute, or resell any Service Content (iii) rent, lease, or sublicense your access to our Services to another person (iv) use any Services or Service Content for any purpose except for your own personal use (v) circumvent or disable any digital rights management, usage rules, or other security features of our Services (vi) use our Services in a manner that overburdens, or that threatens the integrity, performance, or availability of, our Services or (vii) remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on any portion of our Services or any Service Content.

Restricted Areas of the Services

Certain parts of our Services, including account management features, may be password-restricted to registered users or other authorized persons ("Password-Protected Areas"). If you are authorized to gain access to any Password-Protected Areas, you agree that you are entirely responsible for maintaining the confidentiality of your password, and agree to notify us if the password is lost, stolen, disclosed to an unauthorized third party, or otherwise may have been compromised. You agree that you are entirely responsible for any and all activities that occur under your account, whether or not you are the individual who undertakes such activities. You agree to immediately notify us of any unauthorized use of your account or any other breach of security in relation to your password or our Services that is known to you.

We do not not implement account or session time-outs or automatically log users out of our services.

Disclaimer of Warranties

We do not warrant that the services will be uninterrupted or error-free; nor does it make any warranty as to the results that may be obtained from the use of the services. The services are provided "as is" and service provider disclaims all warranties, express or implied, including, but not limited to implied warranties of merchantability and fitness for a particular purpose and non-infringement.

Limitation of Liability

Notwithstanding anything to the contrary, except for bodily injury of a person, neither party shall be responsible or liable with respect to any subject matter of this terms of use related thereto under any contract, negligence, strict liability or other legal or equitable theory: (a) for error or interruption of use or for loss or inaccuracy or corruption of data or cost of procurement of substitute goods, services or technology or loss of business or profits; (b) for any indirect, exemplary, incidental, special or consequential damages; (c) for any matter beyond a party's reasonable control; or (d) for any amounts that, together with amounts associated with all other claims, exceed the fees actually paid by customer to service provider for the applicable services under this agreement or relating to any subject matter of this agreement in the 12 months prior to the act that gave rise to the liability, even if the party has been advised of the possibility of any of the foregoing types of losses or damages. Customer acknowledges that an interruption in service(s) due to circumstances beyond the reasonable control of service provider, such as a failure of telecommunications or network systems not controlled by service provider, shall not be considered a service outage or service deficiency for purposes of any remedy provided in this agreement.

Your privacy is important to us. This Privacy Policy explains our practices regarding the collection, use and disclosure of information that we receive through our Services. If you do not want to receive such email messages, you will be given the option to opt out. We will try to comply with your request(s) as soon as reasonably practical. Additionally, even after you opt out from receiving marketing messages from us, you will continue to receive administrative messages from us regarding our Services (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Service, technical and security notices).

In addition, you may opt out of allowing third-party online advertising networks to collect information from our Site by adjusting the browser settings on your computer or mobile device. Please refer to your mobile device or browser's technical information for instructions on how to delete and disable cookies, and other tracking tools.

Protection of Personal Information

Hashboard cares about the security of your Personal Information, and we make reasonable efforts to ensure a level of security appropriate to the risk associated with the processing of your Personal Information. We maintain organizational, technical, and administrative procedures designed to protect your Personal Information against unauthorized access, deletion, loss, alteration, and misuse. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you believe that your interaction with us is not secure, please contact us immediately.

You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from Hashboard. Your privacy settings may also be affected by changes to the functionality of third-party sites and services that you add to the Hashboard Service, such as single sign on. Hashboard is not responsible for the functionality or security measures of any third party. Upon becoming aware of a breach of your Personal Information, we will notify you as quickly as we can and will provide timely information relating to the breach as it becomes known in accordance with any applicable laws and regulations or as is reasonably requested by you.

Cookies

Yes. We use cookies to remember information so that you don't have to re-enter it during your visit or the next time you visit the Site, to understand and save your preferences for future visits, to compile aggregate data about site traffic and site interaction, to provide custom, personalized content, support, or information, including advertising. Unlike persistent Cookies, session Cookies are deleted when you log off from the Services and close your browser. Although most browsers automatically accept Cookies, you can change your browser options to stop automatically accepting Cookies or to prompt you before accepting Cookies. Please note, however, that if you don't accept Cookies, you may not be able to access all portions or features of the Site or the Services. Who at Hashboard may access your Personal Information?

Designated members of our staff may access Personal Information to help our customers with any questions they have, including help using our Services, investigating security issues, or following up on bug fixes with a customer. This activity is logged in our system for compliance, and we maintain different levels of access for its employees depending on their role in our company.

Do we disclose any information to outside parties?

Except as set out below, we do not sell, trade, or otherwise transfer to outside parties your Personal Information.

How do we handle global transfers and processing of your Personal Information?

Personal Information may be stored and processed in any country where we have operations, or where we engage service providers. This means that we may collect your Personal Information from, transfer it to, and store and process it in the United States and other countries outside of where you live. For example, some of our third-party providers may be located in different countries.
